These Terms & Conditions ("Terms") govern your use of the Pinguin service ("Service") provided by Boyan Valchev ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Who we are
The Service is operated by Boyan Valchev, an individual sole trader. Throughout these Terms, references to "Pinguin" refer to the Service offered by Boyan Valchev.
2. The Service
Pinguin helps you discover things to do in a destination, organise them into day plans, and save itineraries. Free and paid features may change over time as the product evolves.
3. Acceptance & eligibility
By creating an account or otherwise using the Service you confirm that you are of legal age in your jurisdiction and that you accept these Terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
4. Your account
- You are responsible for the accuracy of information you provide.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- Notify us promptly of any unauthorised use of your account.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Send spam or otherwise abuse communications features.
- Infringe the intellectual property or privacy rights of others.
- Probe, scan, scrape, reverse engineer, or interfere with the security or integrity of the Service, including by introducing malware or attempting unauthorised access.
- Resell, redistribute, or otherwise commercialise the Service or its outputs without our written permission.
6. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Boyan Valchev and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal trip planning within the plan you have selected.
7. User content
You retain ownership of plans, notes, and other content you create. You grant us a limited licence to host, store, and process that content solely to provide the Service to you.
8. Service level
We work hard to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. Suggestions, opening hours, prices, routes, and other third-party data may be inaccurate or out of date — please verify important details before you travel.
9. Payments & subscriptions
Our order process and all payments are conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, which apply to your purchase in addition to these Terms. See also our Refund Policy.
10. Suspension & termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay fees due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete associated data after a reasonable period.
11. Warranty disclaimer
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnity
You agree to indemnify Boyan Valchev against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
14. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If a change is material we will take reasonable steps to notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of Bulgaria, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the competent courts of Bulgaria, save for mandatory consumer protection rights you enjoy in your country of residence.
